In Wisconsin, there are various drug-related offenses with which you may be charged. Two of the most common are: Possession of a Controlled Substance and Possession of a Controlled Substance with Intent to Deliver. For both of these charges, the prosecutor must prove:
1) The Person possessed a Substance,
2) The Substance was a “Controlled Substance,” meaning, marijuana, meth, etc., and
3) The Person knew/believed the Substance was a “Controlled Substance,” meaning, marijuana, meth, etc.
In addition to all of the above, for Possession of a Controlled Substance with Intent to Deliver, the prosecutor must also prove:
4) The Person intended to deliver the Substance.
