In Wisconsin, there are varying degrees of sexual assault, for example, First, Second, or Third Degree Sexual Assault. The degree charged against you varies depending on factors such as, the alleged amount of force involved or whether a weapon is alleged to have been used.
For First Degree Sexual Assault, the prosecutor must prove:
1) The Accused had sexual contact or sexual intercourse with a Person,
2) The Person did not consent to the sexual contact or sexual intercourse, and
3) The Accused had sexual contact or sexual intercourse with the Person by use or threat of use of a dangerous weapon or article used/fashioned by the Accused in a manner to lead the Person to reasonably believe it was a dangerous weapon.
